ACLU demanda a N. Mexico por maltrato

La Unión Estadounidense de Libertades Civiles (ACLU) de Nuevo México y el Centro Legal para Inmigrantes de Nuevo México demandaron el viernes a una compañía de prisiones privadas por el tratamiento de nueve inmigrantes detenidos en el Centro de Detención del Condado de Torrance.

La demanda se centra en el uso de gas pimienta por parte de los guardias el año pasado cuando los inmigrantes protestaron por las malas condiciones de vida, y lo que dijeron que eran precauciones inadecuadas contra el COVID-19.

También se quejaron de que se estaban reteniendo las actualizaciones de estado de sus casos de inmigración.

La demanda alega que el operador del centro de detención, CoreCivic, violó el derecho de los inmigrantes a estar libres de fuerza excesiva o arbitraria.

“Nuestros clientes, que vinieron a Estados Unidos en busca de seguridad de la persecución, se manifestaban pacíficamente contra las pésimas condiciones de vida y el trato. En lugar de tratarlos con dignidad y compasión, los guardias optaron por rociarlos con agentes químicos y someterlos a un mayor trauma”, indicó Nadia Cabrera-Mazzeo, abogada de la ACLU.

La líder describió el incidente como un «abuso de poder grave», y agregó que el sistema de inmigración necesita un cambio.

CoreCivic en un comunicado expresó que ha seguido las pautas federales con respecto a COVID-19 y que los guardias se vieron obligados a tomar medidas después de que los detenidos se volvieron perturbadores y se negaron a cumplir las órdenes verbales.

La Comisión del Condado de Torrance también es nombrada como acusada por presuntamente no cuidar a las personas detenidas en las bartolinas.

La Fiscalía del condado no se ha querido pronunciar.

Los abogados de los inmigrantes aseguran que el incidente comenzó el 11 de mayo de 2020, cuando los nueve demandantes iniciaron una huelga de hambre por las condiciones en el centro de detención, tres días después, alegaron que los guardias equipados con escudos y máscaras de gas desplegaron varios botes de gas pimienta en un área confinada.

Los detenidos empezaron a toser. Algunos perdieron el conocimiento.

La demanda sostiene que el personal de CoreCivic no descontaminó adecuadamente a los demandantes ni les brindó atención médica, lo que resultó en daños durante días. Varios de ellos dieron positivo por COVID-19 en unos días, y dos que tenían antecedentes de enfermedad mental intentaron suicidarse después del incidente.

CoreCivic explicó que el personal del centro de detención intentó reducir la situación pero no tuvo éxito, por lo que fue entonces cuando se utilizó el aerosol.

La compañía aseveró que los detenidos luego obedecieron, el personal médico revisó a todas las personas involucradas en la protesta y que no hubo heridos como resultado del incidente.

The American Civil Liberties Union of New Mexico and the New Mexico Immigrant Law Center on Friday sued a private prison company over the treatment of nine immigrant detainees at the Torrance County Detention Center.

The lawsuit centers on the use of pepper spray by guards last year as the immigrants protested poor living conditions and what they said were inadequate COVID-19 precautions. They also complained that status updates on their immigration cases were being withheld.

The lawsuit alleges that the detention center operator, CoreCivic, violated the immigrants’ rights to be free from excessive or arbitrary force.

“Our clients, who came to the United States seeking safety from persecution, were peacefully demonstrating against dismal living conditions and treatment,” said Nadia Cabrera-Mazzeo, a staff attorney with the ACLU. “Rather than treating them with dignity and compassion, guards chose to spray them with chemical agents and subject them to further trauma.”

She described the incident as a “gross abuse of power,” adding that the immigration system is in need of change.

CoreCivic in a statement said it has followed federal guidelines regarding COVID-19 and that guards were forced to take action after the detainees became disruptive and refused to comply with verbal orders.

The Torrance County Commission also is named as a defendant for allegedly failing to care for the people being detained at the lockup. The county attorney did not immediately return a message seeking comment.

Attorneys for the immigrants say the incident began May 11, 2020, when the nine plaintiffs began a hunger strike over conditions at the detention center. Three days later, they alleged that guards equipped with shields and gas masks deployed multiple canisters of pepper spray in a confined area. The detainees began coughing. Some lost consciousness.

The lawsuit contends that CoreCivic staff failed to properly decontaminate the plaintiffs or provide them with medical care, resulting in harm for days. Several of them tested positive for COVID-19 within days, and two who have a history of mental illness attempted suicide in the aftermath of the incident.

CoreCivic said detention center staff tried to deescalate the situation but were unsuccessful, so that’s when the spray was used. The detainees then became compliant. The company said medical staff reviewed all individuals involved in the protest and that no injuries occurred as a result of the incident.
